Who these terms are with

These terms are an agreement between you, the subscribing company, and FlexiShift Planner, the operator of FlexiShift Planner ("we", "us"). By creating a workspace you accept them.

What the service is

FlexiShift Planner is software for scheduling shift staff, recording attendance and leave, managing loans and deductions, and calculating pay. It is provided over the internet on a subscription.

We may improve or change features over time. We will not remove something you rely on without telling you first.

Your responsibilities

• Give accurate company and contact details, and keep them current.
• Keep sign-in details secure, and remove access for people who leave.
• Have the authority and a lawful reason to hold the staff information you enter, and tell your staff how it is used.
• Check and confirm the tax, levy, working-time, leave and public-holiday figures for your country. Figures we supply — including any drafted automatically — are a starting point only. You remain responsible for their accuracy and for the pay you produce with them.
• Use the service lawfully, and not to store anything unlawful or to attempt to reach another company's workspace.

Not legal, tax or accounting advice

Employment contracts, payslips, statutory figures and compliance prompts in the app are general templates and calculations. They are not legal, tax or accounting advice. Have them checked by a qualified adviser before you rely on them.

Trial, subscription and price

New workspaces get a 30-day free trial with full access and no card required. Demonstration workspaces run on sample data and last 14 days.

After the trial, the subscription is charged monthly or annually in advance. The price follows the number of staff on the workspace and is shown on the Billing page before you commit.

If your staff count changes, the price changes with it from the next billing period. We give at least 30 days' notice of any change to our published rates.

Paying

Payment is by card, or by bank transfer (EFT) where offered for your country. An EFT invoice carries our banking details, a unique payment reference and a 7-day due date.

Card payments are taken automatically each period until you cancel.

Late payment and suspension

If an invoice is unpaid three days after its due date, we email a final notice and show a banner in the workspace warning that service will be suspended within 24 hours.

If it is still unpaid after that, the workspace becomes read-only: you can still see and export your records, but nothing new can be added.

Paying at any point lifts the suspension immediately. Nothing is deleted because of non-payment.

Cancelling

You can cancel from the Billing page at any time. Access continues to the end of the period you have paid for, and there is no refund of the current period.

We may end the agreement on 30 days' notice, or immediately for unlawful use, refunding any period paid for but not used.

Your data on exit

Your workspace data remains yours throughout. Export it at any time from the reports and export tools.

After an account closes, the workspace is retained for 90 days so it can be reinstated, then deleted. Ask us sooner and we will delete it sooner. How we handle personal information is set out in our privacy notice.

Availability

We aim to keep the service available at all times, but we do not guarantee uninterrupted access. Planned maintenance is announced in advance where possible.

Limits of liability

Nothing here limits liability for fraud, death or personal injury caused by negligence, or anything that cannot be limited by law.

Otherwise, our total liability in any 12-month period is limited to the subscription fees you paid us in that period.

We are not liable for indirect or consequential loss, lost profit, or for pay calculated from figures you entered or confirmed.

Governing law

These terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction.
